REGISTRATION To use CLICK2TECH Services, You must submit a complete CLICK2TECH registration form which is available on the CLICK2TECH web site (“Site”). As part of the registration process for the Services, USER agrees to: (1) provide certain limited information about Customer as prompted to do so by the Services (such information to be current, complete and accurate) and (2) maintain and update this information as required to keep it current, complete and accurate. The information requested on original signup shall be referred to as registration data (“Registration Data”). If CLICK2TECH discovers that any of Your Registration Data is inaccurate, incomplete or not current, CLICK2TECH may terminate USER right to access and use the Services immediately upon notice. CLICK2TECH will evaluate the registration application in good faith and will notify USER in a timely manner regarding acceptance or rejection. CLICK2TECH may reject a registration application if it determines, in its sole discretion that the user is not an appropriate subscriber or user of the Services. CLICK2TECH reserves the right to refuse the Services to any user who has canceled any number of previous Services accounts. CLICK2TECH need not provide a reason for its rejection. If CLICK2TECH rejects your application, then You may reapply and CLICK2TECH will reconsider the application. You may not register for private use ( i.e.: not belonging to any commercial or public entity). Upon acceptance of this agreement and completion of the registration process you will have opened an account with CLICK2TECH and will become a subscriber to the CLICK2TECH Services.
SERVICES CLICK2TECH service technicians are available to assist USER with online computer problems. The service is available anywhere in the world, provided users have Internet and/or telephone access. A CLICK2TECH service includes USER interaction with a live technician who will attempt to repair and/or improve the performance of USER computer system by downloading client connection software and additional software utilities to USER system. Such utilities includes but not limited to: cleanup utilities, computer operating system updates, desktop application updates of all kind, peripherals drivers and updates, removal and reinstallation of existing software packages/applications. USER agrees and understands that USER system must be in good mechanical working condition in order to prevent any system failure at the time of support. USER system shouldn’t contain any material and information that is not complies with the law. CLICK2TECH responsibility is to report to authority if it believes that a crime has, may have or will be committed in the future or it CLICK2TECH finds such information at the time of service.
AVAILABILITY OF SERVICE Subject to the terms and conditions of this Agreement, CLICK2TECH shall attempt to provide services 10 hours per day, 9:00am to 6:00pm PST, five (5) days per week (Monday-Friday). USER agrees that from time to time CLICK2TECH services may be inaccessible or inoperable for any reason, including, without limitation: (1) equipment failures, (2) periodic maintenance procedure or repairs which CLICK2TECH may undertake, (3) causes beyond the control of CLICK2TECH or which are not reasonably foreseeable by CLICK2TECH, including without limitation, interruption or failure of telecommunication or digital transmission lines, hostile network attacks, network congestion or other failures.
FEES In consideration for CLICK2TECH providing its services, USER agrees to pay CLICK2TECH a service fee. The service fees relate to a single personal computer only and is charged base on the service acquired by USER. Additional fees may require for other computer systems owned by USER. CLICK2TECH reserves the right to increase the fees at any time and the increased fees shall only be posted on the CLICK2TECH website, which USER should review before ordering CLICK2TECH services. USER need to provide CLICK2TECH with a valid credit card belong to USER with sufficient available funds to pay the applicable Services Fees. In the event of charge back or credit card cancellation CLICK2TECH will keep it’s right to receive alternate payment from USER which includes the original service charge plus the additional expenses that CLICK2TECH accumulate in order to collect payment from USER.
LIMITATION OF LIABILITY USER is advised that there is always the possibility that online technical support may be interrupted by system hardware or software failure. In the event of such failure, USER will still be charged for services rendered by CLICK2TECH and will have the right for continued charged service after the recovery from such failure provided for additional charge by either CLICK2TECH or other party. By accepting the Terms and Conditions, USER agrees that CLICK2TECH Shell not be liable for any direct, indirect, consequential, incidental or any other general damages of any kind, including, without limitation, those resulting from negligent or criminal acts of third parties, loss of use, loss of data, lost profits, or computer hardware damage, in connection with any of its services. It is agreed that USER must have his/her important information backed up before CLICK2TECH online computer repair service.
RIGHT OF REFUSAL CLICK2TECH reserves the right to refuse, suspend or terminate any of its services in its discretion to USER, without notice. Reasons for service refusal includes, but are not limited to: USER using computer system fraudulently or illegally, USER computer system holds obscene, pornographic, abusive, harassing or threatening material or any USER misconduct, insulting or abusive behavior while working with CLICK2TECH representative.
Termination. Any of CLICK2TECH service or maintenance agreement shall commence on the date USER accepts CLICK2TECH terms and conditions and proceed with the purchasing of CLICK2TECH. CLICK2TECH service shall continue in effect until USER system is back in good condition or upon termination of service by either USER. CLICK2TECH, in its sole discretion, may also terminate service to USER for any reason and without notice, including, without limitation, if CLICK2TECH believes that USER have violated or acted inconsistently with the letter or spirit of the Terms, or if USER are in breach of the terms of this Agreement or any of the payment terms. USER agrees that CLICK2TECH shall not be liable to USER or any third party as a result of CLICK2TECH suspension or termination of services.
DISCLAIMER OF WARRANTIES USER EXPRESSLY AGREE THAT USE OF CLICK2TECH SERVICES IS AT HIS/HER SOLE RISK. CLICK2TECH SERVICES ARE PROVIDED ON AN “AS IS” BASIS. CLICK2TECH DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. CLICK2TECH MAKE NO WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH THE SERVICES. CLICK2TECH MAKE NO WARRANTY THAT ITS SERVICES WILL MEET USER REQUIREMENTS OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY OR ERROR FREE. USER UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED (INCLUDING PLUG-INS) THROUGH THE USE OF CLICK2TECH SERVICES IS DONE AT USER OWN RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER RESULTING FROM THE USE OF CLICK2TECH SERVICE. NO INFORMATION OR ADVICE, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM CLICK2TECH OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO USER.
